Terms of Service

1. Acceptance of Terms

By accessing or using the Sevil.ai platform (the "Service"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please discontinue use of the Service immediately.

2. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted on the Service with a revised "Last Updated" date. Your continued use after changes are posted constitutes acceptance of the new Terms.

3. Service Description

Sevil.ai provides AI-powered chat functionality utilizing uncensored language models, rendered entirely client-side for maximum privacy and performance. We grant you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

4. Eligibility & Account Registration

  • You must be at least 16 years old (or the minimum age in your jurisdiction) to use the Service.
  • If registration is required for certain features, you agree to provide accurate, current, and complete information and to maintain its accuracy.
  • You are solely responsible for safeguarding your account credentials and for all activities conducted under your account.

5. User Conduct

You agree not to:

  1. Violate any applicable laws, regulations, or third-party rights.
  2. Use the Service for unlawful, harmful, or abusive activities (including harassment, defamation, hate speech, or threats).
  3. Upload or transmit any viruses, malware, or malicious code.
  4. Reverse engineer, decompile, or attempt to extract the Service's source code, models, or algorithms.
  5. Interfere with the operation of the Service, servers, or networks.
  6. Share access credentials or permit unauthorized third-party access.

6. Content Ownership & Responsibility

  • User Content: You retain ownership of all inputs (prompts, messages) and AI-generated outputs. By using the Service, you grant Sevil.ai a worldwide, royalty-free license to process and render your content locally for purposes of providing and improving the Service.
  • Your Responsibility: You are solely responsible for the content you input and the outputs you generate. Sevil.ai disclaims any liability for any claims, damages, or losses arising from your use of the Service or content produced, including any third-party claims or negative consequences.
  • Feedback: Any suggestions or feedback you submit become Sevil.ai's exclusive property.

7. Paid Plans & Billing

We may offer subscription plans or paid features. All fees are in USD and exclusive of applicable taxes unless otherwise stated.

7.1 Billing & Renewal

  • Subscriptions automatically renew at the end of each billing period unless canceled before renewal.
  • You may cancel or change your subscription at any time via your account settings; changes take effect at the next billing cycle.

7.2 No Refunds

  • All purchases are final. We do not offer refunds, credits, or exchanges for any reason, including dissatisfaction with the Service or content generated.

8. Intellectual Property

All trademarks, service marks, logos, and content of Sevil.ai (excluding User Content) are our intellectual property. Any unauthorized use is strictly prohibited.

9. Third-Party Services & Links

  • The Service may integrate with or link to third-party websites, tools, or services. Your use of those third parties is subject to their terms and privacy policies.
  • Sevil.ai is not responsible for third-party practices or content.

10. Disclaimers & Warranties

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.
  • SEVIL.AI DOES NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE PERFORMANCE, OR ACCURACY OF AI OUTPUTS.
  • YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY BE INACCURATE, OFFENSIVE, OR OTHERWISE UNSUITABLE, AND YOU ASSUME ALL RISKS ASSOCIATED WITH ITS USE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEVIL.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sevil.ai and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

13. Termination

  • We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
  • Upon termination, your license to use the Service ends, but Sections 6, 7.2, 10, 11, 12, 15, 16, and 17 will survive.

14. Force Majeure

Neither party will be liable for any failure or delay in performing its obligations due to causes beyond its reasonable control, including acts of God, war, terrorism, natural disasters, or network failures.

15. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

16. Governing Law & Venue

These Terms are governed by the laws of Miami-Dade County, Florida, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of state and federal courts in Miami-Dade County for any disputes.

17. Dispute Resolution & Arbitration

  • Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration under the American Arbitration Association's rules, except where prohibited by law.
  • You may opt out of arbitration within 30 days of your first use of the Service by emailing privacy@sevil.ai.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sevil.ai regarding the Service.
